PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE Ghost Inc. SERVICE. BY ACCESSING OR USING OUR SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND ALL APPLICABLE LAWS AND REGULATIONS. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU ARE PROHIBITED FROM USING OR ACCESSING THIS SERVICE.

1. ACCEPTANCE OF TERMS

1.1. These Terms of Service ("Terms", "Terms of Service", "Agreement") govern your use of the Ghost Inc. website and services (collectively, the "Service") operated by Ghost Inc. ("us", "we", "our", "the Company").

1.2. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1.3. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1.5. By using this Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Service.

2.1. Ghost Inc. provides a web-based proxy service that allows users to access websites through our servers. The Service acts as an intermediary between your device and the websites you wish to visit.

2.2. The Service is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.

2.3. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service.

2.4. The Service may be modified, updated, interrupted, suspended, or discontinued at any time without notice or liability.

2.5. We reserve the right to refuse service to anyone for any reason at any time.

2.6. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices.

2.7. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

3. USER RESPONSIBILITIES AND CONDUCT

3.1. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials that you submit, post, or display on or via the Service.

3.2. You agree that you will not use the Service to:

3.2.5. Upload, post, email, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.

3.2.6. Upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

3.2.7. Upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.

3.2.8. Upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

3.2.9. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies, or regulations of networks connected to the Service.

3.2.10. Intentionally or unintentionally violate any applicable local, state, national, or international law.

3.2.11. Stalk or otherwise harass another person.

3.2.12. Collect or store personal data about other users in connection with the prohibited conduct and activities set forth above.

3.3. You acknowledge that Ghost Inc. does not pre-screen content, but that Ghost Inc. and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Service.

3.4. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

3.5. You acknowledge, consent, and agree that Ghost Inc. may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to comply with legal process, enforce these Terms of Service, respond to claims that any content violates the rights of third parties, respond to your requests for customer service, or protect the rights, property, or personal safety of Ghost Inc., its users, and the public.

4. DISCLAIMER OF LIABILITY

4.1. YOU EXPRESSLY UNDERSTAND AND AGREE THAT Ghost Inc. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF Ghost Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

4.1.1. THE USE OR THE INABILITY TO USE THE SERVICE.

4.1.2. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE.

4.1.3. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.

4.1.4. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE.

4.1.5. ANY OTHER MATTER RELATING TO THE SERVICE.

4.2. Ghost Inc. IS NOT RESPONSIBLE FOR ANY CONSEQUENCES THAT MAY ARISE FROM YOUR USE OF THE SERVICE IN VIOLATION OF ANY POLICIES, RULES, OR REGULATIONS OF ANY INSTITUTION, ORGANIZATION, EMPLOYER, SCHOOL, UNIVERSITY, OR OTHER ENTITY.

4.3. IF YOU USE THE SERVICE TO BYPASS, CIRCUMVENT, OR OTHERWISE AVOID ANY NETWORK RESTRICTIONS, FIREWALLS, CONTENT FILTERS, OR OTHER SECURITY MEASURES IMPLEMENTED BY ANY INSTITUTION, ORGANIZATION, EMPLOYER, SCHOOL, UNIVERSITY, OR OTHER ENTITY, YOU DO SO ENTIRELY AT YOUR OWN RISK.

4.4. Ghost Inc. EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR ANY DISCIPLINARY ACTION, SUSPENSION, EXPULSION, TERMINATION, LEGAL ACTION, OR OTHER CONSEQUENCES THAT MAY RESULT FROM YOUR USE OF THE SERVICE.

4.5. YOU ACKNOWLEDGE AND AGREE THAT Ghost Inc. HAS NO CONTROL OVER, AND ASSUMES NO RESPONSIBILITY FOR, THE CONTENT, PRIVACY POLICIES, OR PRACTICES OF ANY THIRD-PARTY WEBSITES OR SERVICES.

4.6. YOU FURTHER ACKNOWLEDGE AND AGREE THAT Ghost Inc. SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH THE USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS, OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH WEBSITES OR SERVICES.

4.7. WE STRONGLY ADVISE YOU TO READ THE TERMS OF SERVICE AND PRIVACY POLICIES OF ANY THIRD-PARTY WEBSITES OR SERVICES THAT YOU VISIT.

5. SCHOOL AND INSTITUTIONAL NETWORK POLICIES

5.3. Ghost Inc. DOES NOT ENCOURAGE, ENDORSE, OR SUPPORT THE VIOLATION OF ANY INSTITUTIONAL POLICIES, ACCEPTABLE USE AGREEMENTS, OR OTHER TERMS AND CONDITIONS.

5.4. Before using the Service on any institutional network, you should carefully review and understand all applicable policies and agreements. If you are unsure whether the use of the Service is permitted, you should consult with the appropriate administrators or authorities at your institution.

5.5. Ghost Inc. IS NOT RESPONSIBLE FOR AND EXPRESSLY DISCLAIMS ANY LIABILITY FOR:

5.5.1. Any violation of institutional policies, acceptable use agreements, or other terms and conditions that may result from your use of the Service.

5.5.2. Any disciplinary action, including but not limited to warnings, detention, suspension, expulsion, termination of employment, or other consequences that may result from your use of the Service.

5.5.3. Any loss of network access, computer privileges, or other technology-related privileges that may result from your use of the Service.

5.5.4. Any notation on your academic record, employment record, or other official records that may result from your use of the Service.

5.5.5. Any legal action, civil or criminal, that may result from your use of the Service.

5.6. You acknowledge and agree that you are solely responsible for understanding and complying with all applicable institutional policies and agreements.

5.7. You acknowledge and agree that the consequences of violating institutional policies can be severe and may have long-lasting effects on your academic career, employment prospects, and personal reputation.

5.8. Ghost Inc. STRONGLY ENCOURAGES ALL USERS TO RESPECT AND COMPLY WITH THE POLICIES OF THEIR INSTITUTIONS.

6. NETWORK SECURITY AND FIREWALL BYPASS

6.1. The Service may be used to access websites and online resources that are blocked or restricted by network firewalls, content filters, or other security measures.

6.2. YOU ACKNOWLEDGE AND AGREE THAT THE USE OF THE SERVICE TO BYPASS NETWORK SECURITY MEASURES MAY BE PROHIBITED BY LAW IN SOME JURISDICTIONS.

6.3. YOU ACKNOWLEDGE AND AGREE THAT THE USE OF THE SERVICE TO BYPASS NETWORK SECURITY MEASURES MAY VIOLATE THE TERMS OF SERVICE OR ACCEPTABLE USE POLICIES OF YOUR INTERNET SERVICE PROVIDER, EMPLOYER, SCHOOL, OR OTHER INSTITUTION.

6.4. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR DETERMINING WHETHER YOUR USE OF THE SERVICE IS LEGAL AND PERMITTED IN YOUR JURISDICTION AND UNDER ANY APPLICABLE AGREEMENTS OR POLICIES.

6.5. Ghost Inc. DOES NOT PROVIDE LEGAL ADVICE AND CANNOT ADVISE YOU ON WHETHER YOUR USE OF THE SERVICE IS LEGAL OR PERMITTED.

6.6. IF YOU ARE UNSURE WHETHER YOUR USE OF THE SERVICE IS LEGAL OR PERMITTED, YOU SHOULD CONSULT WITH A QUALIFIED LEGAL PROFESSIONAL BEFORE USING THE SERVICE.

6.7. Ghost Inc. EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR ANY LEGAL CONSEQUENCES THAT MAY RESULT FROM YOUR USE OF THE SERVICE TO BYPASS NETWORK SECURITY MEASURES.

6.8. You acknowledge that network administrators and security personnel may be able to detect your use of proxy services and may take action against you as a result.

6.9. Ghost Inc. IS NOT RESPONSIBLE FOR AND CANNOT PREVENT THE DETECTION OF YOUR USE OF THE SERVICE BY NETWORK ADMINISTRATORS OR SECURITY PERSONNEL.

7. ASSUMPTION OF RISK

7.1. BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL RISKS ASSOCIATED WITH SUCH USE.

7.2. You acknowledge that the use of proxy services carries inherent risks, including but not limited to:

7.2.1. The risk of detection by network administrators, security personnel, or automated monitoring systems.

7.2.2. The risk of disciplinary action by schools, employers, or other institutions.

7.2.3. The risk of legal action, civil or criminal.

7.2.4. The risk of loss of network access, computer privileges, or other technology-related privileges.

7.2.5. The risk of damage to your academic record, employment record, or personal reputation.

7.2.6. The risk of exposure to harmful, offensive, or inappropriate content.

7.2.7. The risk of exposure to malware, viruses, or other security threats.

7.2.8. The risk of interception or monitoring of your communications or data.

7.2.9. The risk of identity theft or other forms of fraud.

7.2.10. The risk of financial loss.

7.3. You acknowledge that this list of risks is not exhaustive and that other risks may exist.

7.4. YOU EXPRESSLY AGREE THAT YOU HAVE CAREFULLY CONSIDERED THESE RISKS AND HAVE MADE AN INFORMED DECISION TO USE THE SERVICE DESPITE THESE RISKS.

7.5. YOU EXPRESSLY AGREE THAT YOU WILL NOT HOLD Ghost Inc. LIABLE FOR ANY DAMAGES, LOSSES, OR OTHER CONSEQUENCES THAT MAY RESULT FROM ANY OF THESE RISKS.

8. INDEMNIFICATION

8.1. You agree to indemnify, defend, and hold harmless Ghost Inc., its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Service or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.

8.2. You agree to indemnify and hold harmless Ghost Inc. from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service, your violation of any law or the rights of a third party, or your use of the Service.

8.3. You agree to indemnify and hold harmless Ghost Inc. from any claim or demand, including reasonable attorneys' fees, made by any institution, organization, employer, school, university, or other entity due to or arising out of your use of the Service in violation of their policies, rules, or regulations.

8.4. You agree to indemnify and hold harmless Ghost Inc. from any legal action, civil or criminal, that may result from your use of the Service.

8.5. You agree to cooperate fully with Ghost Inc. in the defense of any claim that is subject to indemnification under these Terms of Service.

8.6. Ghost Inc. reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such matter without the prior written consent of Ghost Inc..

9. LIMITATION OF LIABILITY

9.1. IN NO EVENT SHALL Ghost Inc., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR ANY THIRD-PARTY INFORMATION PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS OF SERVICE.

9.2. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF Ghost Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

9.3. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, Ghost Inc.'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9.4. IN NO EVENT SHALL Ghost Inc.'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

9.5. You acknowledge and agree that Ghost Inc. has set its prices and entered into these Terms of Service in reliance upon the limitations of liability set forth herein, and that the same form an essential basis of the bargain between the parties.

10. DISCLAIMER OF WARRANTIES

10.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2. Ghost Inc. EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

10.3. Ghost Inc. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

10.4. Ghost Inc. DOES NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

10.5. Ghost Inc. DOES NOT WARRANT THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

10.6. Ghost Inc. DOES NOT WARRANT THAT ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

10.7. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

10.8. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Ghost Inc. OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.

11. INTELLECTUAL PROPERTY

11.1. The Service and its original content, features, and functionality are and will remain the exclusive property of Ghost Inc. and its licensors.

11.2. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

11.3. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Ghost Inc..

11.4. You acknowledge that Ghost Inc. owns all right, title, and interest in and to the Service, including without limitation all intellectual property rights.

11.5. You agree not to copy, modify, adapt, translate, prepare derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Service or any portion thereof, except as expressly permitted in these Terms of Service.

11.6. You acknowledge that you do not acquire any ownership rights by using the Service.

12. USER CONTENT

12.1. You retain all rights in, and are solely responsible for, the content you post, upload, or otherwise make available through the Service.

12.2. By posting content through the Service, you grant Ghost Inc. a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media.

12.3. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize Ghost Inc. to use all intellectual property rights in and to any content that you post, upload, or otherwise make available through the Service.

12.4. You represent and warrant that neither your content nor your use of the Service will violate any applicable law or infringe on the rights of any third party.

12.5. Ghost Inc. does not endorse any content posted by users and is not responsible for the accuracy, reliability, or legality of any such content.

13. PRIVACY

13.1. Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

13.2. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

15.2. You acknowledge that the laws regarding the use of proxy services vary by jurisdiction and that you are solely responsible for understanding and complying with the laws applicable to you.

15.3. You acknowledge that the use of the Service to engage in illegal activity is strictly prohibited and may result in criminal prosecution and/or civil liability.

15.4. Ghost Inc. cooperates with law enforcement authorities when required by law or when Ghost Inc. believes in good faith that such cooperation is necessary to protect the safety, rights, or property of Ghost Inc., its users, or the public.

15.5. You agree not to use the Service to violate any export control laws or regulations.

15.6. You agree not to use the Service to access, download, or distribute any material that is illegal in your jurisdiction.

16. COMPUTER FRAUD AND ABUSE

16.1. You acknowledge that the Computer Fraud and Abuse Act (CFAA) and similar laws in other jurisdictions prohibit unauthorized access to computer systems and networks.
